DR20: Driving or attempting to drive while unfit through drink

This code applies when a driver is deemed unfit to drive due to alcohol consumption, regardless of whether the legal limit is exceeded.

DR30: Driving or attempting to drive then refusing to provide a specimen for analysis

They are issued when a driver refuses to provide a breath, blood, or urine sample for alcohol testing after being stopped by the police.

DR40: In charge of a vehicle with an alcohol level above the limit

This code applies if a driver is found in control of a vehicle while their alcohol level is above the legal limit, even if they are not driving.

It’s important to know that you can still be charged with a DR40 conviction even if you’re sitting or sleeping in your car after drinking. If the police believe you intended to drive or could have driven while over the limit, you can be prosecuted. This means you can’t “sleep it off” in your car after drinking — even if the engine is off and you don’t have the keys in the ignition.

DR50: In charge of a vehicle while unfit through drink

Given when a driver is in control of a vehicle and is deemed unfit to drive due to alcohol consumption, regardless of whether they exceed the legal limit.
